Welcome to the 100x Profit AI application and any other products or services owned or operated by Apps by Koketso ("Company," "we," "us," or "our") (collectively, the "100x Profit AI Service"). To access the 100x Profit AI Service, you must at all times agree to and abide by these Terms of Use, including any additional guidelines, and any future modifications (collectively, these "Terms"). These Terms are a legal contract between you, a user of at least 18 years of age ("you" or "User"), and Apps by Koketso regarding your use of the 100x Profit AI Service.
By accessing, installing, browsing, using, subscribing to, or registering for the 100x Profit AI Service (including any content created, uploaded, downloaded, copied, published, or propagated during your use of the 100x Profit AI Service), you acknowledge that you have read, understood, and agree to be bound by these Terms. If at any time you do not agree to these Terms, please terminate your use of the 100x Profit AI Service.
Although the 100x Profit AI Service is always striving to improve, it is not perfect. While we make reasonable efforts to ensure the information provided is accurate, we cannot ensure the accuracy, completeness, or reliability of any information, data, or content on the Service. You agree and understand that during your use of the 100x Profit AI Service, no content feedback should be relied upon as the basis for any civil or commercial activities; otherwise all risks and responsibilities arising from such activities are borne by you, not by Apps by Koketso.
Your access to and use of the 100x Profit AI Service is subject to all applicable international, national, federal, state, and local laws and regulations. You represent and warrant that you will not use the 100x Profit AI Service in any manner or for any purpose that is unlawful or prohibited by these Terms. When using the 100x Profit AI Service, you may be subject to additional posted guidelines or terms and conditions applicable to specific services and features which may be posted from time to time (the "Guidelines"). All such Guidelines are incorporated by reference into these Terms.
In addition, your use of the 100x Profit AI Service is governed by our Privacy Policy (the "Privacy Policy"), which is incorporated by reference into these Terms. You consent to the collection, use, and disclosure of personal information in accordance with the Privacy Policy.
We may revise these Terms from time to time. We may include a notice in the Service that the Terms have been modified, but such notice may not remain in place for an extended period. You should review the Terms as posted in the Service from time to time. Using the 100x Profit AI Service after any revised Terms have been posted constitutes your acceptance of the revised Terms.
Subject to these Terms, we grant you a limited, revocable, non-transferable, non-exclusive, non-sublicensable license to use the 100x Profit AI Service (and all updates or upgrades provided) solely for private, non-commercial purposes in accordance with these Terms.
The 100x Profit AI Service is owned and operated by Apps by Koketso. The content, visual interfaces, information, graphics, design, compilation, computer code, products, software, algorithms, services, and all other elements of the 100x Profit AI Service provided by us ("Apps by Koketso Materials") are protected by copyright, trade dress, patent, and trademark laws, international conventions, and other intellectual property and proprietary rights laws. All trademarks, service marks, and trade names are proprietary to Apps by Koketso or its affiliates and/or third-party licensors.
As a condition of your use of the 100x Profit AI Service, you will not use the Service for any purpose that is unlawful or prohibited by these Terms. Access to Apps by Koketso Materials and the Service from territories where their contents are illegal is strictly prohibited. Users are responsible for complying with all local rules, laws, regulations, and policies.
You shall not use the 100x Profit AI Service to create, upload, download, copy, publish, or propagate any materials or content that violate laws, harm others, or contain obscenity, violence, or threats.
You hereby grant Apps by Koketso a worldwide, non-exclusive, irrevocable, royalty-free, fully-paid, perpetual, sublicensable, fully transferable license to use, distribute, reproduce, create derivative works from, publish, translate, publicly perform, and publicly display any Content that you upload or publish to the 100x Profit AI Service.
We may, in our sole discretion, terminate any account or access to the 100x Profit AI Service at any time and for any reason. We are not responsible for deletion or loss of your content. Suspected fraudulent, abusive, or illegal activity may be referred to law enforcement authorities.
THE 100x PROFIT AI SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You agree to indemnify and hold Apps by Koketso and its affiliates harmless from any claims, damages, or losses arising out of your use or misuse of the 100x Profit AI Service or violation of these Terms.
UNDER NO CIRCUMSTANCES SHALL APPS BY KOKETSO OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE 100x PROFIT AI SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Any disputes arising out of or relating to the 100x Profit AI Service shall first be attempted to be resolved amicably. If unresolved after 60 days, disputes shall be referred to binding arbitration under the laws of South Africa. Arbitration shall be conducted in English.
These Terms constitute the entire agreement between you and Apps by Koketso. If any provision is found invalid, the remaining provisions remain in full effect. These Terms are governed by the laws of South Africa, without regard to conflicts of laws.
