Welcome to the Monument & Landmark Identifier application and any other products or services owned or operated by Apps by Koketso ("Company," "we," "us," or "our") (collectively, the "Service"). To access the Service, you must at all times agree to and abide by these Terms of Use, including any additional guidelines, and any future modifications (collectively, these "Terms"). These Terms are a legal contract between you, a user of at least 18 years of age ("you" or "User"), and Apps by Koketso regarding your use of the Service.
By accessing, installing, browsing, using, subscribing to, or registering for the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If at any time you do not agree to these Terms, please terminate your use of the Service.
Monument & Landmark Identifier uses artificial intelligence (AI) to identify places, landmarks, and monuments, and to provide travel-related information and historical facts. While we strive for accuracy, AI systems can sometimes produce incorrect, incomplete, or misleading information. You agree that no content in the Service should be relied upon as the sole basis for critical navigation, travel safety decisions, or academic sourcing. All risks arising from the use of AI-generated information are borne by you.
When using the camera or photo upload features, you agree not to submit images that are illegal, offensive, explicit, or infringe upon the intellectual property or privacy rights of any third party.
The Service may offer auto-renewing subscriptions and in-app purchases. If you choose to purchase a subscription, payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period. Account will be charged for renewal within 24-hours prior to the end of the current period. Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase.
Your access to and use of the Service is subject to all applicable international, national, federal, state, and local laws and regulations. You represent and warrant that you will not use the Service in any manner or for any purpose that is unlawful or prohibited by these Terms. The Service is intended for users aged 13 and older. If you are under 13, please do not use the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. You consent to the collection, use, and disclosure of information in accordance with the Privacy Policy.
We may revise these Terms from time to time. Using the Service after any revised Terms have been posted constitutes your acceptance of the revised Terms.
Subject to these Terms, we grant you a limited, revocable, non-transferable, non-exclusive, non-sublicensable license to use the Service solely for private, non-commercial purposes in accordance with these Terms.
The Service is owned and operated by Apps by Koketso. The visual interfaces, design, compilation, computer code, software, and all other elements of the Service provided by us are protected by copyright, trade dress, patent, and trademark laws. All trademarks and service marks are proprietary to Apps by Koketso or its affiliates and/or third-party licensors.
We may, in our sole discretion, terminate any account or access to the Service at any time and for any reason. Suspected fraudulent, abusive, or illegal activity may be referred to law enforcement authorities.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You agree to indemnify and hold Apps by Koketso and its affiliates harmless from any claims, damages, or losses arising out of your use or misuse of the Service or violation of these Terms.
UNDER NO CIRCUMSTANCES SHALL APPS BY KOKETSO OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
